Terms of Service

1. The short version

eVibes is a free casual polling platform. By using it you agree to:

• Be cool. Don't post hateful, illegal, or harmful content.
• Be honest. Don't try to manipulate vote results, impersonate others, or stuff ballots beyond what casual fun allows.
• Own your stuff. You're responsible for what you create. We can remove anything that violates these terms.
• Accept that this is a beta-grade platform. We provide it as-is, do our best, and can't promise zero downtime or perfect data.

2. Who can use eVibes

You can use eVibes if you're at least 13 years old (or the minimum age in your country to use online services). If you're under 18, your parent or guardian should be aware that you're using it.

If you're using eVibes on behalf of a business or organization, you confirm you have the authority to bind that organization to these terms.

3. Your account

Creating vibe checks requires an account (voting does not). When you sign up:

• You provide a name, email address, and password
• You're responsible for keeping your password secure
• You're responsible for everything that happens under your account
• One person per account — no sharing
• You can delete your account at any time by contacting us

4. What you can create

You can create vibe checks on pretty much any topic — that's the point. But there are limits.

You agree NOT to create vibe checks that:

• Promote violence, harassment, or hatred against any group
• Sexualize or endanger minors in any way
• Contain or solicit illegal activity (drugs, weapons, fraud, etc.)
• Defame, slander, or harass identifiable individuals
• Spread medical, electoral, or scientific misinformation that could cause real-world harm
• Violate someone else's intellectual property (e.g. using copyrighted images, trademarks)
• Include personal information about others without their consent (doxxing)
• Are spam, scams, or commercial promotions disguised as polls
• Attempt to phish, deceive, or extract data from voters

We reserve the right to remove any vibe check that violates these rules, with or without notice, and to suspend or terminate accounts that repeatedly violate them.

5. Voting and participation

Voting on public vibe checks doesn't require an account. We use a small cookie to prevent accidental double-voting from the same browser, plus light IP-based rate limiting to prevent rapid-fire spam. These measures are casual — they're not designed to stop determined attackers, and eVibes results should never be relied on for high-stakes decisions like elections, contracts, or anything where vote integrity actually matters.

Don't use eVibes for anything legally or financially significant. It's a vibe check, not a verified poll.

6. Content you create

You keep ownership of your content. The vibe checks, questions, and options you create remain yours.

By posting content on eVibes, you grant us a worldwide, royalty-free license to display, store, distribute, and promote that content as part of operating the service. This license ends when you delete the content or your account, except where copies have already been shared by others (e.g. screenshots, embedded results) or where we need to keep records for legal reasons.

If you mark a vibe check as Public, it appears in the trending feed and can be viewed and voted on by anyone with the link. If you mark it Private, it's only accessible to people you share the URL with.

7. Your responsibilities at events and venues

If you use eVibes' kiosk display mode at a physical venue (restaurant, mall, event, conference, etc.), you are responsible for:

• Ensuring the displayed vibe check is appropriate for your audience and venue
• Complying with any local regulations about displays, advertising, or public polling
• Moderating any inappropriate content that may appear
• Not implying any official endorsement of poll results by eVibes

eVibes is provided as a tool. How you use it at your venue is your responsibility.

8. Things you can't do

You agree NOT to:

• Reverse-engineer, scrape at scale, or attempt to disrupt the service
• Use bots, scripts, or automated tools to stuff votes
• Resell, white-label, or sublicense access to eVibes without our written permission
• Attempt to gain unauthorized access to other users' accounts or vibe checks
• Use eVibes to send spam or unsolicited messages
• Misrepresent your identity or affiliation in vibe check content

9. Service availability and changes

eVibes is provided as-is and as-available. We don't guarantee:

• Uninterrupted uptime or zero downtime
• That all your data will be perfectly preserved forever
• That every feature will work in every browser, device, or country
• That the service will remain free, free of ads, or in its current form

We may change, suspend, or discontinue features at any time, with reasonable notice when practical.

10. Disclaimers and limitation of liability

To the maximum extent permitted by law:

• eVibes is provided without warranties of any kind, express or implied — including fitness for a particular purpose, accuracy, or non-infringement.
• We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
• Our total liability for any claim arising from your use of eVibes is limited to the greater of $50 or the amount you've paid us in the past 12 months (which for free accounts is zero).
• You agree to indemnify and hold eVibes harmless from claims arising out of your content, your use of the service, or your violation of these terms.

Some jurisdictions don't allow these limitations, in which case they apply to the maximum extent permitted by law.

11. Termination

You can stop using eVibes any time. We can suspend or terminate your account or remove your content if you violate these terms, with or without notice. We're not obligated to recover deleted accounts or content.

12. Changes to these terms

We may update these terms occasionally. When we make material changes, we'll post the updated version here and update the "Last updated" date. Continuing to use eVibes after changes means you accept the new terms.

13. Governing law

These terms are governed by the laws of the United States and the state in which eVibes is operated, without regard to conflict-of-law principles. Disputes will be resolved in the courts of that jurisdiction.
